Center defends sedition law, says previous ruling by Supreme Court binding

The Center today defended the sedition law and asked the Supreme Court to dismiss the petitions challenging it. The court is hearing petitions challenging the constitutional validity of the colonial-era law.

In a written submission, the Center told a three-judge bench headed by Chief Justice NV Ramana that the decision to uphold the sedition law in Kedarnath Singh v State of Bihar is binding. It also said that the three-judge bench cannot examine the validity of the law. “A Constitutional Bench has already examined all aspects of Section 124A (Sedition Act) with reference to fundamental rights like right to equality and right to life,” the government told the Supreme Court.

The petitions challenging the sedition law were filed by five parties including the Editors Guild of India and Trinamool MP Mahua Moitra.

A three-judge special bench comprising Chief Justice NV Ramana and Justices Surya Kant and Hima Kohli on Tuesday heard the petitions challenging the validity of the sedition law.

Concerned over the rampant misuse of the penal law on sedition, the apex court had in July last year asked the Center why it was not repeal the provision used by the British to silence people like Mahatma Gandhi to suppress the freedom movement. Was.

While agreeing to consider the petitions, the court had said that its main concern is “abuse of law” due to which the number of cases is increasing.
