The Delhi High Court has rejected a plea by a man convicted in a dowry death case to allow him to travel to Saudi Arabia for the Haj pilgrimage during Eid ul Juha (Bakrid) in July.
Justice Neena Bansal Krishna while dismissing the prayer observed that the petitioner, who is on bail due to suspension of sentence during the period pending appeal against the conviction, did not disclose the documents or details about his intended journey in the application and This is also not a passport.
“In such circumstances, with the particulars missing in the application, it is dismissed,” the judge said in the order on Tuesday.
“The only fact disclosed in the application is that the petitioner intends to attend the Haj pilgrimage on the occasion of Eid ul Juha on 10th July, 2022. Neither the petitioner is in possession of a passport, nor does he have any document or details which indicate this. Revealing about his desired journey,” she said.
The petitioner was convicted in 2010 under sections 304B (dowry murder)/308 (attempt to culpable homicide not amounting to murder)/34 (common intention) of the Indian Penal Code.
He has been sentenced to 10 years rigorous imprisonment under section 304B and fine of Rs 1 lakh under section 308 and additional rigorous imprisonment of 5 years and fine of Rs 50,000.
The prosecution had opposed his application considering the gravity of the offence.
